Terms of Service

1. Acceptance of Terms

By accessing or using Genosm ("Service"), you agree to be bound by these Terms of Service. If you do not agree to all terms, you may not use the Service.

2. Description of Service

Genosm provides a web-based genogram creation and analysis platform for healthcare professionals. Features include AI-powered genogram generation, clinical insights, and document export capabilities.

3. Account Registration

  • •You must provide accurate account information
  • •You are responsible for maintaining account security
  • •One account per individual user
  • •You must be 18 years or older to use the Service

4. Subscription & Payment

Trial Period

  • •1-week free trial with payment information required (Monthly and Yearly plans only)
  • •Trial includes 5 AI calls
  • •Cancel anytime before the trial ends to avoid being charged.
  • •Lifetime plan does not include a trial (one-time purchase)

Billing

  • •Monthly ($9.99/month), Yearly ($99.99/year), or Lifetime ($149.99 one-time) plans available
  • •Monthly and Yearly subscriptions auto-renew unless cancelled
  • •Lifetime plan is a one-time purchase with permanent access to all core features (excludes AI features)
  • •Strict no-refund policy for all processed charges (see Section 5 for details)
  • •Price changes will be communicated 30 days in advance

5. Refund Policy

Genosm operates a strict refund policy to ensure the sustainability of our platform and AI processing costs:

  • • Trial Cancellations: You must cancel your subscription before the 7-day trial period expires to avoid any charges.
  • • No Refunds After Trial: Once the trial period ends and your card has been processed or charged, no refunds will be entertained under any circumstances.
  • • Subscription Renewals: Monthly and Yearly renewals are processed automatically. It is the user's responsibility to cancel before the renewal date. No refunds are provided for renewal charges.
  • • Lifetime Purchases: All Lifetime plan purchases are final and non-refundable.

6. Acceptable Use

You agree NOT to:

  • ✗Use the Service for any unlawful purpose
  • ✗Attempt to reverse engineer the Service
  • ✗Share your account credentials
  • ✗Interfere with service operation
  • ✗Violate any applicable laws or regulations

7. Data, Privacy & Mandatory PHI Shield for AI

Your use of the Service is governed by our Privacy Policy. Please review the following strict terms:

Local-First Architecture vs. AI Processing: Standard manual diagramming and diagram storage are 100% local-first—your data remains entirely on your device and is never sent to Genosm servers. However, when using optional AI features (such as natural language genogram generation, incremental edits, or clinical insights), prompts and diagram payloads are transmitted over secure connections to external AI model providers.

Mandatory User Compliance Requirements for AI:

  • • Mandatory PHI Shield Usage: You are strictly required to keep the built-in PHI Shield enabled whenever sending data to AI features. You must never transmit raw, unmasked Protected Health Information (PHI) or Personally Identifiable Information (PII) to AI endpoints.
  • • Mandatory Pre-Transmission Review: Genosm provides an automated, client-side PHI Shield and Interstitial Review Tray. However, you are strictly required to inspect all detected token chips prior to sending any prompt and manually tag (+ Tag Custom) any unusual names, identifiers, or details that were not automatically masked.
  • • Prohibition on Use Without PHI Shield: If you do not intend to use, review, and verify the PHI Shield, or if you do not agree to take full responsibility for PHI de-identification, you are strictly prohibited from using Genosm AI features.
  • • Sole User Responsibility & Release: By using Genosm AI features, you explicitly agree that compliance with HIPAA, HITECH, GDPR, PIPEDA, and all professional clinical confidentiality obligations is solely and exclusively your responsibility. Genosm disclaims any liability arising from your failure to properly mask, review, or sanitize clinical data before AI transmission.

8. Intellectual Property

  • •The Service, its design, and its code are owned by Genosm
  • •You retain full and complete ownership of your genograms and clinical data
  • •You grant us only the limited license necessary to process data on your behalf to provide the Service

9. Clinical & AI Disclaimers

Professional Clinical Judgment: Genosm and its AI features are diagramming assistance tools, not medical or diagnostic software. They are not a substitute for professional clinical judgment, diagnostic assessment, or therapeutic expertise.

Verification Required: AI can make mistakes. Clinicians must independently review, verify, and validate all AI-generated family relationships, kinship lines, and medical history markers on the canvas before using or exporting records.

10. Limitation of Liability

To the maximum extent permitted by law, Genosm shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use of the Service.

11. Changes to Terms

We may update these Terms. Continued use after changes constitutes acceptance. Material changes will be communicated via email or in-app notification.
